Terms and Conditions


1) The Parties.

Easy Reserve Limited, located at 308 The Capel Building, Mary's Abbey, Dublin 7 - Ireland hereafter called Easyreserve and the client hereafter called Owner agree on the following:

2. Non-Exclusive Agreement.

The agreement for the supply of services is on a non-exclusive basis between the Owner and Easyreserve. The Owner acknowledges that all of the data entered on the website with regard to the Owner property is the Owner's responsibility. The Owner is solely responsible for the accuracy of the data. Easyreserve makes no claims to have verified the data. Any claims made by renters due to the inaccuracy of the data will be the solely the responsibility of the Owner.

3. Term of the agreement.

The agreement will be in effect for one year starting from the date of its affirmation. The agreement will automatically renew unless one of the parties sends a written notice via e-mail at least 30 days before the annual expiration date. This notification must be sent to the email address: support@easyreserve.com An acknowledgement will be sent by the receiving party to signify the termination of the agreement.

4. Subject.

Easyreserve is in the business of providing information to the public regarding rental properties. The rental properties are displayed on the Easyreserve websites for the public to view. The Owner either directly owns or is responsible for managing a rental property and wishes to use Easyreserve's public websites in order to promote his/her rental property. To this end Easyreserve agrees to the following:

A. Create 5-8 web pages regarding the Owner's rental property.

B. Include up to 20 pictures of the rental property on the web pages.

C. Promote the web pages on the Easyreserve websites as well as other external websites which Easyreserve has made arrangements for this purpose. The number of external sites may vary as agreements are entered into or cancelled.

The Owner agrees to the following:

A. Supply detailed and accurate descriptions of the property including detailed descriptions of all units within the property.

B. Supply up to 20 photographs that accurately represent the advertised property and units.

C. Verify the accuracy of the information once the web pages are published for public view.

D. Owner will not hold Easyreserve responsible in any way whatsoever for the accuracy of the description(s) published. Easyreserve reserves to right to cancel without notice any and all properties advertised that it deems to have misleading or false descriptions or photographs.

5. Copyrights.

The Owner agrees the all the websites operated by Easyreserve are copyrighted. The Owner agrees not to use, in any way whatsoever, the published web pages without the express written consent of Easyreserve and only in that case the name and address of Easyreserve and its internet sites must be clearly acknowledged.

6. Changes of the Agreement.

The Owner accepts that changes to the agreement may become necessary in the future. Easyreserve reserves the right to make such changes to the agreement if it deems them necessary in order to continue providing service to the Owner. lf any changes are made to the agreement, the Owner will be notified 60 days before any changes to due to take effect via e-mail notification, unless cancellation is made according to the terms on the agreement.

7. Duties and Responsibilities of the Owner.

The Owner acknowledges that Easyreserve is not able to exercise any control on the authorization of the rental and on the legitimacy and accuracy of the material provided. As a consequence the Owner substantially and legally discharges Easyreserve from any loss, damage, responsibility, cost and expense, including possible legal costs deriving from the infringement of the above quoted rules. The Owner guarantees the exactness and trueness of the data he has provided, and declares that the premises he wishes to rent and the relative annexes will be in perfect condition for the whole length of the present agreement . The Owner must immediately modify his property presentation regarding any changes in the rented properties condition, both externally and internally, including possible damages inflicted by third parties. In case the Owner, contrary to what is stated in the agreement, is not able to make the indicated properties available, Easyreserve reserves the right to ask for compensation of the costs which have been actually incurred for the publication of the property on its internet sites, and for the specific costs Easyreserve incurred for advertising.

8. Duties of Easyreserve.

Easyreserve will attempt to keep the websites operational to the best of its ability for the entire duration of the agreement, with the exception of possible interruptions due to the service maintenance, which will be communicated to the Owner in advance. The web pages will be available for public view within 30 days from the completion of the data entry and following the Easyreserve review of the property presentation. The same will apply of all subsequent updates made by the Owner. Easyreserve is not responsible for interruptions to service caused by Acts of God or Acts of War.

9. Resolutory clause and interruption of the agreement.

Easyreserve reserves the right to resolve the present agreement, through communication forwarded to the customer by e-mail or fax. In all cases we reserve the right of being reimbursed for the damages we could possibly sustain.

10. Use of Personal Data.

Easyreserve will use the personal data provided by the Owner for the exclusive reason of managing the agreement relationship, and for the best implementation of the services provided; the Owner gives his consent to the handling of his personal data, directly or also through a third party, in case this is required for performing the duties imposed by the law and in order to complete the execution of the agreement. The Owner, in order to advertise his property, give permission to Easyreserve to freely distribute the details referring both to the property as a whole and to the single units it is composed of.

11. Confirmation in Writing of the Visualized Information.

The Owner is expected to print or save on his computer the current agreement in order to get a written confirmation in of the visualised information presented online.

12. Consideration.

For its service Easyreserve will be due, from the Owner, 20% of the gross rental price paid by the renter to the Owner for properties rented through the Easyreserve websites.

This includes all bookings made directly by an owner after the renter has contacted an Easyreserve website. Falilure to pay commisions to Easyreserve for these bookings will result in immediate removal of all properties.

13. Easyreserve direct purchase.

The Owner agrees to allow Easyreserve to purchase rental periods directly, on behalf of our clients, at the same conditions and published prices less the agreed commission.

14. Authorization to Collect Payments

The Owner authorizes Easyreserve to collect on its behalf a minimum payment amount of 20% of the rent that the Owner has arranged for his property/unit for the rental duration period, as final confirmation of the reservation. A higher percentage is allowed and it can be set directly by the owner by changing the percent from the owner pages in the 'Owners Area' of the Easy Reserve Limited web site. Once the reservation is confirmed, Easyreserve will pay the difference between the amount collected and the consideration due (see point 12); the above mentioned amount will be paid through money transfer, within 30 days of receipt of the payment, according to the details the Owner has inserted in the 'Profile Area' within the web pages reserved from the Owner.

15. Dealings between Owner and Tourist (Renter).

The balance of the rent due the Owner will be settled through a direct transaction between the Owner and the Renter. The collection of the balance due by the Renter will be therefore exclusively remitted to the Owner. It is the Owners responsibility to collect the balance of the rent from the Renter. Easyreserve has no obligation or responsibility to collect the balance of rent due the Owner. Renters will be responsible to pay a deposit to the Owner on their arrival. The amount of this deposit will be indicated by the Owner on the web pages; from this amount the extra costs and the refund for possible damages will be deducted: the remaining sum will be returned to the Renter by the Owner when the keys are returned. All damages caused by the Renter must be paid immediately from the Renter to the Owner, and Easyreserve is not liable for them in any way whatsoever. Any disputes that Renters report to Easyreserve will be immediately forwarded to the Owner, who is required to answer as soon as possible and not later than 14 days. The evident negligence of the Owner in satisfying the rightful claims of the Renters will result in the immediate cancellation of the agreement by Easyreserve.

16. Monitoring of Correspondence.

Since the Owner is the one who carries out the negotiations with the Renter, in order to guarantee that Easyreserve is acquainted with the relations originating from its activity, the Owner grants Easyreserve the right to monitor directly every communication between the Owner and the Renter. Accordingly, Easyreserve will hide the contact information of the Renter (phone and fax numbers, email addresses) until the transaction is complete. The correspondence between Renter and Owner will take place through one or more email addresses that Easyreserve will provide. In case the Owner wishes to modify his email address, he must inform Easyreserve immediately, so that the above mentioned activity, and all the other actions listed in the present agreement, can be performed.

17. Availability Updates.

Easyreserve offers the rental of the housing units according to the policies indicated by the Owner, and deals with the Renter on his behalf until the negotiation is complete; in order to achieve this, Easyreserve requires that the Owner immediately gives notice of any change occurred in the availability of the property, through the website's availability calendar dedicated to him, or by this contact form. In the event Easyreserve concludes an agreement with a Renter, which cannot be honored because of the Owner's default in bringing up to date the availability of his property, then the Owner is bound to pay Easyreserve a penalty equal to 20% of the contracted price; moreover, possible further requests for a refund claimed by the Renter will be exclusively the responsibility of the Owner.

18. Intellectual Property of Descriptions.

The liability of the descriptions provided by the Owner for the presentation and publication of the housing units is exclusively of the Owner, nonetheless Easyreserve reserves the right to verify the descriptions, to make alterations and possibly refuse their publication. In case Easyreserve intervenes making some alteration or translating the descriptions into another language, then the intellectual property will be fully assigned to Easyreserve.

19. Intellectual Property of Images.

The Owner who provides his own photographs, symbols, logos, images, graphic creations etc. ,accepting the agreement, declares the relative intellectual property is his own responsibility. Pictures taken or rearranged, or any other object created or rearranged by personnel instructed by Easyreserve, become fully Easyreserve's intellectual property.

20. Extensions of the Present Agreement.

Possible commercial suggestions, such as special offers of various kind, which would involve even a partial change of the present agreement, when arranged subsequently to the agreement itself, will have to be considered as extensions to the present agreement and will leave untouched the rights/duties herewith listed.

21. Registration of the Owner.

In order to create an Owner's web pages, Easyreserve requires at the first registration a payment of 100 Euro, which the Owner accepts to be deducted from the first reservation obtained through Easyreserve itself.

22. Currency.

The currency to be utilized for the advertising in Easyreserve sites is the Euro. All other transactions between Owner and Easyreserve will be made in Euros as well.

23. Class of Property.

All properties listed on the Easyreserve websites have a class associated to the property. A class of 5 is the best and class of 1 is the lowest. Easyreserve relies on the owner to truly and accurately rate the property. This rating is displayed in the websites to give the renters an idea of the type of property they are renting. Easyreserve reserves the right to change a property rating at any times if it deems the property is not rated correctly. If the owner disagrees with the rating they should contact us immediately. The rating is the sole responsibility of the owner. Any complaints arising out of misuse of the property rating system will be the owners responsibility.

24. Enforced Law and Recognized Court.

The law enforceable to the present agreement is that of Ireland, and for each matter which is not provided by the present conditions, the law provisions applied will be those of the relative civil code and of the rules in force. The customer accepts the exclusive jurisdiction of Irish Court for any controversy which might come into being.
